A user or customer is understood to be the internet user who acquires that status by registering on the website using a form, and who is assigned a username and password for which they hold full responsibility of use and safekeeping, being responsible for the accuracy of the personal data provided to the Provider, as set out in the User Registration section.
3. Acceptance
By accepting these Conditions, the User declares:
- That they have the legal capacity to enter into contracts under current legislation.
- That they have read and accept these Conditions.
4. Availability
The User shall have access to the Conditions at all times and in any event prior to commencing the product contracting procedure, and may store and/or reproduce them on a durable medium.
5. Validity and Duration
The period of validity or duration of these Conditions and of any particular contracting conditions shall be for as long as they remain published on the website referred to above, and they shall apply from the moment the User makes use of the website and/or proceeds to contract any products.
6. Amendments
The Provider reserves the right to unilaterally amend these Conditions, provided that this does not affect goods or promotions acquired by the User prior to the amendment.
The User undertakes to read the contracting conditions carefully each time they contract a product, as these may have been amended since the last time they were accessed.
7. Severability
If any clause included in these Conditions is declared wholly or partially null or ineffective, such nullity shall affect only that provision or the part of it that is null or ineffective, with the remainder of the Conditions continuing in force.
8. Purpose of the contract
The purpose of this contract is to govern the contractual sale relationship arising between the Provider and the User at the moment the latter accepts the purchase during the online contracting process by means of the mechanisms set out below.
The contractual sale relationship entails the delivery of one or more specific products in exchange for a set price publicly displayed on the website.
Each of these products may be subject to specific rules by means of its own particular contracting conditions, which are described in more detail in the sections on warranty, returns and withdrawal, or in the product's own technical specification, given the different formats in which the products are sold, their packaging or their inherent nature.

Prior user registration is not required in order to reserve a vehicle through this web portal.
10. Geographical scope
This website AUTOSDOMINGUEZ.ES operates in mainland Spain and also exports to other countries. Hereinafter, this geographical scope shall be referred to as "the Territory". Products are therefore only shipped and distributed within the Territory. Use of this website, as well as any transaction carried out on it, is deemed to take place in Spain and is therefore subject to current Spanish law. The Provider neither accepts nor delivers orders outside the Territory referred to above.
All of the above is without prejudice to the possibility that we may shortly offer these services in the excluded areas, in which case this will be announced in advance on this website.

The Provider pays close attention to the information relating to product characteristics by means of technical descriptions and illustrative photographs. All of this is done within the limits of the available technology and in accordance with market standards.
12. Taxes, currency and shipping costs
In accordance with current legislation, every reservation made through the website is subject to Value Added Tax (VAT).
Prices include Value Added Tax (VAT) and are in all cases expressed in Euros (€). Unless expressly stated otherwise, these prices do not include shipping costs or any other additional services ancillary to the product purchased.

The contracting procedure and the pre-contractual information are available in Spanish and English, these being the languages used to carry out the contract.

This option is not available.
To cancel a reservation you must contact our customer service department immediately.
19. Shipping costs, shipping methods and delivery times
Shipping costs are calculated on a case-by-case basis according to the price of the vehicle.
20. Delivery time
Approximately 7 working days will elapse between correct confirmation of your reservation and delivery of the vehicle requested.
21. Invoice
Where can I access my invoice? The invoice is sent to the customer by email after the contract has been signed.
22. Value Added Tax
In accordance with current legislation, every reservation made through the website is subject to Value Added Tax (VAT).
23. Payment methods
As a general rule, the User may reserve a vehicle by Bank Transfer.
CASH ON DELIVERY IS NOT ACCEPTED
Your card details are not stored in our database, as they are entered on the secure website of the bank you select.
24. General provisions on the Payment Process
- The payment instruction given by the User necessarily implies acceptance of these General Conditions as well as the particular conditions of the order.
- Once payment for the reservation has been successfully completed, the User will receive a confirmation email setting out the essential terms of the transaction.
The Provider reserves the right to cancel payments where there are indications of fraudulent transactions, reporting to the competent authorities any conduct that may be subject to investigation for the prevention of fraud.
25. Returns of defective, damaged or incorrect products, or exercising the right of withdrawal
Once you have received your vehicle, you may withdraw from your purchase within 14 calendar days of receipt.
As these are products that must be used in order to establish whether they work properly, the Provider requires, in order to accept a return, that the product returned is in perfect condition and complete with all its components. You must also ensure that:
- It has not been used incorrectly or negligently, has not been handled inappropriately or carelessly, and has not been subjected to abnormal or damaging conditions.
- It has not been involved in any accident and has not been damaged in an attempt to repair or modify it.
- It has not deteriorated through normal wear and tear following receipt.
If the product fails to meet any of the requirements set out above, we may decide, at our discretion, not to repair or replace the product or refund the amount paid, and/or we may ask you to reimburse the full transport and inspection costs incurred at current standard rates. To obtain such reimbursement, we may charge those costs to your credit or debit card or use the payment details provided when placing the Order.
In the case of a defective product, the Provider shall proceed, as appropriate, to repair, replacement, price reduction or termination of the contract, all of which shall be free of charge for the consumer and user.
Withdrawal may be exercised as follows: by requesting collection from your home, which you may do by sending an email requesting the return together with your contact details and order number, or by contacting our customer service department using the details provided in Section 27.

In accordance with current legislation, you have a statutory period of 14 calendar days from the conclusion of the contract or receipt of the product to cancel your purchase without giving any reason. To exercise this right quickly and easily, you may use our Withdrawal Form or send an unequivocal statement through our Contact Form or to the email address admon@autos-dominguez.com. You will receive an acknowledgement of receipt immediately.
26. Exceptions to the right of withdrawal
The right of withdrawal does not apply to the supply of:
- Goods that are liable to deteriorate or whose nature may be affected.

28. Product warranty
All vehicles offered on our website carry a one-year official warranty from the moment the product is delivered.
This warranty period shall apply, although it does not cover defects caused by negligence, impacts, incorrect use or improper handling, incorrect installation not carried out by authorised Technical Services where applicable, or materials worn through use.
The Provider reserves the right to request verification of the origin of the problem from an official technical service of the brand. Should the defect prove to have a cause unrelated to its origin, the repair will be chargeable. In cases where the warranty applies, repair, replacement of the item, price reduction or refund will be chosen, on the terms established by law.
To make a warranty claim, please contact our Customer Service department by telephone or email, where you will be informed of the procedure to follow.
29. Rights of the Provider
- To maintain, modify or suspend its website without prior notice.
- To modify the price of offers.
- To reject orders due to lack of stock or non-payment by the customer.
- To deny customers access to its IT tools in the event of a breach of these conditions.
- To receive payment for the customer's purchases once the transaction has been accepted.
- To retain title and full ownership of the item until payment in full has been made by the customer.
- To prohibit the reproduction, transfer or disposal of any content published by the Provider without the express permission of the company itself.
- To correct or rectify human or IT errors.
30. Limitation of liability
All information provided by the User to the Provider through the relevant forms must be accurate. It is the User's responsibility to keep the data supplied to the Provider duly up to date. In any event, the Provider accepts no liability for any loss or damage arising as a result of false, insufficient, inaccurate or incorrect information having been provided.
Access to the website does not place the Provider under any obligation to verify the authenticity, suitability, completeness, accuracy, adequacy or currency of the information supplied by the User through the relevant forms.
The Provider shall not be liable in those cases where it falls to the parents, guardians or legal representatives of Users who are minors or lack legal capacity to authorise access, the supply of personal information, the use of the website or the contracting of any products or services provided through the applications or web platform. It shall be the responsibility of those parents, guardians or legal representatives to supervise the minor's or incapacitated person's access to and use of the contracting of products and services provided through AUTOSDOMINGUEZ.ES.
Users' access to the Content does not place the Provider under any obligation to ensure the absence of viruses or other computer elements that may have a harmful effect on the User's computer equipment. In all cases, it is for the User to have in place the tools necessary to detect such viruses or harmful computer elements. Consequently, the Provider shall not be liable for any damage caused to the computer equipment of Users or third parties while accessing the Content.
The Provider shall not be liable for interruptions to electricity or telecommunications services that prevent users from using the services offered.
31. Applicable law and Jurisdiction
These conditions shall be governed by and construed in accordance with Spanish law in respect of anything not expressly provided for. The Provider and the User agree to submit any dispute that may arise from the provision of the products or services covered by these conditions to the Courts and Tribunals of the User's domicile.
Where the User is domiciled outside Spain, the Provider and the User expressly waive any other jurisdiction and submit to the Courts and Tribunals of the domicile of the website owner.
32. Dispute resolution and alternative methods
In accordance with consumer legislation in force in Spain and the European Union, we inform our customers that, in the event of a dispute, they may use impartial, out-of-court alternative dispute resolution (ADR) mechanisms.
From 20 July 2025, the European Commission's Online Dispute Resolution (ODR) Platform will cease to operate. Other alternative methods nevertheless remain available:
